BCSD Cellphone Policy
Phone-Free School Act (AB 3216)
California law requires all school districts to adopt a policy that limits or prohibits student use of smartphones to support focused learning and promote student well-being. In accordance with California Assembly Bill 3216, the Bakersfield City School District (“BCSD”) has updated our policy and procedures regarding student use of smartphones and other mobile communication devices.
Beginning with the 2026-2027 school year, the new policy will go into effect.
The BCSD Board of Education recognizes that smartphone and device use can be harmful to student mental health and disruptive to daily learning. By limiting smartphone distractions, we can create a safer, more productive learning environment for all students and staff.
Expectations Regarding Student Mobile Communication Devices
We recognize that some parents/guardians may choose for their child to possess a smartphone. If a parent/guardian elects to provide a smartphone or other mobile communication device to their child, the parent/guardian must sign a Personal Mobile Communication Device Agreement (“Agreement”).
Any student in possession of a smartphone or other mobile communication device without a signed Agreement will have their device confiscated.

By signing an Agreement parents and their students must adhere to the following:

Devices must be powered off during the school day. Families may contact students, and students may reach parents/guardians, through the school office as needed. -
Devices must be put away in a backpack or otherwise secured out of sight for the entire time a student is under the direct supervision of District staff, including during the school day, practices, games, field trips, and all school-related activities. -
Smart watches may be worn, provided the following features are disabled: Mobile communication services, recording or “listen-in” features, Bluetooth, and notifications. -
Students must receive permission from a school employee before removing or using a mobile communication device from their backpack or other secured location. -
Students are solely responsible for their devices. The school or District staff are not responsible for lost, damaged, or stolen devices. The school or District will not investigate lost, damaged, or stolen devices. -
If a student uses a device in an unauthorized manner while on campus or under the supervision of a District employee, the device may be confiscated in accordance with the progressive consequences outlined in this policy. Any device not claimed within two (2) days after the final day of the school year will be considered abandoned and may be disposed of.

The device will be confiscated, the student will be reminded of cellphone expectations, & will it be returned to them at the end of the day.
The device will be confiscated, the student will be reminded of cellphone expectations, & parents will be notified to retrieve the device from the office.
The device will be confiscated; the student, parent, and administrator will conference to be reminded of cellphone expectations & consequently establish a loss of privilege.
The student will be required to check in the device each morning at the office.
